Resolving Rental Disputes: Legal tools adopted by the Housing Monitor to mitigate landlord-tenant conflicts

Based on Housing Monitor Report of July-August 2021

During July and August, the Housing Monitor followed up on 40 cases of housing vulnerabilities, affecting a total of 188 individuals. This report aims to outline some of the legal strategies adopted by the Housing Monitor’s Legal Task Force to help callers overcome their housing-related difficulties.

بيان لضمان الحقوق السكنية في الأحياء المتضررة من تفجير ٤ آب

منذ صدوره، افتقد قانون "حماية المناطق المتضرّرة بنتيجة الانفجار في مرفأ بيروت ودعم إعادة إعمارها" (قانون ١٩٤/٢٠٢٠) إلى أي سياسة أو رؤية شاملة لإعادة الإعمار تضمن إعادة تنشيط الحياة الاجتماعيّة والاقتصاديّة في تلك المناطق وتأخذ في الاعتبار ضرورة توفير الحماية الفعليّة للسكان المنكوبين بما يسرّع عودتهم إلى منازلهم.

بيان: أولوية الحق في السكن في ظل الأزمات الراهنة

مر لبنان منذ بداية العام 2020 بسلسلة من الإنهيارات، أولهم إنهياراً إقتصادياً مع إفلاس المصارف وحجز ودائع الناس، وثانيهم إنهياراً إجتماعياً مع إفقار الناس نتيجة تدهور سعر الصرف والتضخم الذي واكبه، وثالثاً إنهياراً صحياً مع جائحة كورونا، أخيراً وليس آخراً إنفجار بيروت الذي قضى على أحياء برمتها وأظهر اهمال المسؤولين وعدم مبالاتهم بحياة مئات العائلات ومقتنياتهم وأحيائهم.

Lebanon's international commitment to the Right of Housing: between rhetoric and reality

تبرز مجموعةٌ متنوّعةٌ واسعةٌ من الصكوك الدولية التي تعالج مختلف أبعاد الحق في السّكن الملائم، الأمر الذي حدا بحكومات الدول إلى الاعتراف به كحقٍ من حقوق الإنسان الأساسيّة والسعي إلى تكريسه وصونه. تصدّر لبنان قائمة الدول التي كرّست هذا الحق وواكبت تطوّره في القانون الدولي.

Migrant workers and refugees are facing a dilemma as the specter of eviction hovers in an economic crisis threatening the right to housing

Rent is a primary way to access housing in the Lebanese cities which house diverse social classes. The percentage of tenants in Beirut reaches 49.5% of its total population. Nonetheless, the available figures are limited to rental contracts signed under registered legal contracts, thus excluding conventional arrangements that are not registered in the municipalities or are agreed upon without written contracts.

How did Official Authorities Tackle the Housing Crisis Caused by the Beirut Port Explosion?

Hours after the port explosion devastated Beirut, the governor, Judge Marwan Abboud, appeared tearfully on television, declaring that about 300,000 people had become homeless in the Lebanese capital. With this news, individuals, organizations, and associations rushed to offer their homes and headquarters to receive the victims. As for the relevant authorities, however, they showed little haste in mobilizing, but rather seemed to rely almost completely on the initiatives of volunteers and survivors

Home Loans Exacerbate Inequality

Since the 1990s, the state has ignored the urgent need for a policy that addresses the multifaceted housing crisis. Instead, the state has adopted a unilateral approach of offering loans for home ownership. Despite the financial burdens that borrowers have been bearing for decades, this approach made home ownership the primary way for securing safe and sustainable housing.

نص القانون صراحة على تعليق اقساط الديون المتأثرة من آثار انتشار فيروس كورونا لدى المصارف أو كونتوارات التسليف وتجميد جميع استحقاقات القروض والفوائد المستحقة عليها من 2020/4/1 لمدة ستة أشهر اي لغاية شهر ١٠/٢٠٢٠.

Housing Priority in Light of the Coronavirus – What are the Measures Taken Globally?

The housing crisis in Lebanon is not novel, and measures to combat the Coronavirus pandemic did not create it. This crisis has always been evident in the incredibly escalating prices of real estate and apartments, and in the continuous rise in rent prices. Nevertheless, the spreading pandemic did position housing at the center of the debate about public health, the resilience of the healthcare sector, and community security.

أتى هذا القانون ليعلق، سريان جميع المهل القانونية والقضائية والعقدية الممنوحة بهدف ممارسة الحقوق على أنواعها سواء اكانت مهل شكلية، إجرائية او يمتد أثرها الى أساس الحق. وشمل القانون المعجل المواد الإدارية والمدنية والتجارية وذلك من تاريخ ١٨ تشرين اول ٢٠١٩ حتى٣٠ تموز ٢٠٢٠ ضمنا. ومن جملة الاستثناءات التي أتى عليها هذا النص، استثنى صراحة كافة المهل الواردة في قانون الإيجارات تاريخ ٩/ ٥/ ٢٠١٤ والمعدل بموجب القانون رقم ٢/٢٠١٧ (الإيجارات القديمة).
